The offer and sale of products on our site are governed by these General Conditions of Sale.

The products purchased on our site are sold directly by PEGASO FIRENZE S.R.L., hereinafter referred to as PEGASO FIRENZE S.U.R.L. it is registered in the Florence Business Register with the administrative economic repertory number 605670, Fiscal Code and I.V.A. 06162550484. The headquarters of PEGASO FIRENZE S.U.R.L. is in Italy, in Via degli Olmi 65, Sesto Fiorentino 50019 (Fi).

Definitions

PEGASO FIRENZE S.R.L. offers for sale the products and carries out its e-commerce activity towards final consumers.

These General Conditions of Sale exclusively regulate the offer, transmission and acceptance of purchase orders for products on the site between users of the site itself and PEGASO FIRENZE S.R.L ..

The General Conditions of Sale do not regulate the supply of products by different subjects that are present on our site through links, banners or other hypertext links. We advise you to check the conditions of sale of these subjects before making any purchases.

How to conclude the purchase contract with PEGASO FIRENZE S.R.L.

To conclude the contract of purchase of one or more products on our site, you will have to fill in the order form in electronic format and send it to PEGASO FIRENZE S.R.L., electronically, following the relative instructions.

The order form contains a link to the General Conditions of Sale with the acceptance clause of the use of data relating to the law on privacy and the exercise of the right of withdrawal, information on the essential characteristics of each product and the relative price (including all applicable taxes or taxes), the means of payment that you can use to purchase each product and how to deliver the products purchased, shipping costs and delivery.

Conclusion of the contract, PEGASO FIRENZE S.R.L. will take charge of your purchase order.

PEGASO FIRENZE S.R.L. may not process your purchase orders that do not give sufficient guarantees of solvency or that are incomplete or incorrect or in case of unavailability of products. In these cases, we will inform you by e-mail that the contract is not concluded and that PEGASO FIRENZE S.R.L. has not followed up your purchase order specifying the reasons

If the products presented on our site are no longer available or on sale at the time of sending the purchase form, it will be PEGASO FIRENZE S.R.L. communicate, promptly and in any case within thirty (30) days from the day following the one in which you have transmitted your order to PEGASO FIRENZE S.R.L., the unavailability of the ordered products.

In this case, PEGASO FIRENZE S.R.L. will reimburse the amount already paid. With the electronic transmission of the order form, you unconditionally accept and undertake to observe, in the reports of PEGASO FIRENZE S.R.L., these General Conditions of Sale. If you do not share some of the terms in the General Conditions of Sale, please do not submit the order form for the purchase of products on our site.

Conclusion of the contract, PEGASO FIRENZE S.R.L. will send you, by e-mail, a receipt of the purchase order, containing a summary of the information already contained in the order form (information related to the essential characteristics of the product and the detailed indication of the price, the means of payment used and of the delivery costs applied).

Guarantees and indication of product prices.

The prices shown on the site are valid only for purchases made online.

The essential characteristics of the product are presented on our website within each product page. The images and colors of the products on sale may, however, not correspond to the real ones due to the Internet browser and the monitor used.

PEGASO FIRENZE S.R.L. does its best to ensure that the information contained on the Website is accurate and up-to-date. However, it is not possible to offer guarantees. The Customer acknowledges and accepts that the Products may not fully comply with the indications, specifications and / or photographs on the Website.

The weight indicated for some typical products admits a 10% tolerance because they are not packaged using industrial methods.

Product prices may be subject to updates. Make sure of the final sale price before submitting the relevant order form.

PEGASO FIRENZE S.R.L., in case of exercise of your right of withdrawal, has the right not to accept the return of products that do not have the relative packaging or that have been altered in their essential and qualitative characteristics or that have been damaged or even used only partially.

Payments

For the payment of the price of products and shipping costs you can follow one of the methods indicated in the purchase form. The information entered will never be used by PEGASO FIRENZE S.R.L. if not to complete the procedures related to your purchase and to issue the related refunds in the event of any refunds of the products, as a result of exercising your right of withdrawal, or if it becomes necessary to prevent or report to the police the commission of fraud on our website. The price for the purchase of products and shipping costs, as indicated in the order form will be debited to your current account at the time of the purchase order.

Shipping and delivery of products

The methods and shipping costs are indicated in the purchase form. The user has the faculty to choose the desired option during its compilation. Please pay attention to what is reported in the section Shipping methods and costs because the indications are an integral and substantial part of these General Conditions of Sale and, therefore, they consider yourself fully known and accepted at the time of transmission of the purchase form .

Right of withdrawal

You have the right to withdraw from the contract concluded with PEGASO FIRENZE S.R.L., without any penalty and without specifying the reason, within ten days (10) from the day of receipt of the products purchased on our site. (D.L. N. 206 OF 6-9-2005)

You will have to return the products contained in their original packaging to PEGASO FIRENZE S.R.L .. The only expenses that you will have to pay are the shipping costs for the return of the products purchased.

The right of withdrawal applies only to intact goods at the time of return and can not be exercised for those products that have already been used by the customer.

If the right of withdrawal is exercised according to the terms and conditions envisaged, PEGASO FIRENZE S.R.L. reimburses any sums already collected for the purchase of products, excluding shipping costs for delivery of products purchased.

PEGASO FIRENZE S.R.L. will return, in addition to the sums collected for the purchase of products, shipping costs for delivery of products purchased, only in the event that the return of the products is due to causes attributable to PEGASO FIRENZE S.R.L., as in the case where the products they show defects in production or there have been errors in the delivery of the same.

The withdrawal must be communicated by e-mail to the e-mail address info@tiurai.it.

This communication must specify the reference order, the desire to withdraw from the purchase and the product or products for which it intends to exercise the right of withdrawal and must be accompanied by a copy of the documentation received with the order.

You will then be sent a return form by e-mail where the procedures will be indicated and a return code. You will then have to communicate to the e-mail address info@tiurai.it the bank details where we can make the transfer of the sum to be returned and the authorization number previously sent by us. The shipping costs, remember, are at your charge and vary depending on the amount of goods to be returned.

The amounts paid will be reimbursed within thirty (30) days from the date on which PEGASO FIRENZE S.R.L. returned in possession of the goods shipped, after checking the status of the return. We will activate the reimbursement procedures once we have verified the correct execution of the terms and conditions indicated above.

If the methods and terms for exercising the right of withdrawal are not respected, you will not be entitled to reimbursement of the amounts already paid to PEGASO FIRENZE S.R.L .; however, you can recover, at your expense, the products in the state in which they were returned to PEGASO FIRENZE S.R.L .. Otherwise, PEGASO FIRENZE S.R.L. may retain the products, in addition to the sums already paid for their purchase.

Times and methods of reimbursement

After returning the products, PEGASO FIRENZE S.R.L. provides for the necessary checks regarding their compliance with the terms and conditions indicated. In the event that the checks are concluded positively, PEGASO FIRENZE S.R.L. will send you, by e-mail, the relative confirmation of acceptance of the returned products.

Whatever the method of payment, the refund is activated by PEGASO FIRENZE S.R.L. within thirty (30) days from the date on which PEGASO FIRENZE S.R.L. has become aware of the exercise of your right of withdrawal after verification of the correct execution of the same and acceptance of the returned products.

If there is no correspondence between the recipient of the products indicated in the order form and who made the payment of the amount due for their purchase, the repayment of the amounts paid, in case of exercise of the right of withdrawal, will be performed by PEGASO FIRENZE SRL, in any case, towards those who made the payment.

The value date of the credit will be the one in which the refund will be made.

In any case PEGASO FIRENZE S.R.L. will make the refund and send the money exclusively to the countries included in the list of countries where the goods are shipped.

Applicable law and settlement of disputes

The General Conditions of Sale are governed by Italian law and in particular by the Legislative Decree of 22 May 1999, n. 185 on the subject of distance contracts and the legislative decree 9 April 2003, n. 70 on certain aspects concerning electronic commerce.

By way of derogation from the rules in force, the parties hereby agree to define the Court of Florence as the exclusive competent forum for any and all disputes.

The technical procedures to comply with these provisions are contained in the technical specification, Annex B of Legislative Decree 196 of 30/6/2003.

Times and methods of repayment

Following your desire to withdraw from the purchase of the product or products for which you intend to exercise the right of withdrawal, you will be sent a return form by e-mail where you will find the exact procedures and a code to be used to make the return. You will then have to communicate to the e-mail address customerservice@tiurai.it the bank details where we can make the transfer of the sum to be returned and the return authorization number that we have previously sent. The shipping costs, remember, are at your charge and vary depending on the amount of goods returned. The return of the goods must be entrusted exclusively to the courier we have previously commissioned. The package will be collected only at the address where we have shipped the goods purchased.

Please note that from the moment you send the return form via e-mail, the courier will have already been authorized to collect the goods. Therefore, remember to have already prepared the package to be returned and to have applied the same part of the form including the authorization number.

In case you have used the free shipping please note that you will have to pay the costs of returning the package that will be communicated by PEGASO FIRENZE S.R.L. at the time of return authorization. This sum will be deducted from the refund that will be made later. In fact PEGASO FIRENZE S.R.L. reserves to pay only the cost of the courier linked to the sale.

Whatever the method of payment, the refund is activated by PEGASO FIRENZE S.R.L.enter thirty (30) days from the date on which PEGASO FIRENZE S.R.L. has become aware of the exercise of your right of withdrawal after verification of the correct execution of the same and acceptance of the returned products.
